END USER LICENSE AGREEMENT (VER 2017-1) (“EULA”)

General

This EULA applies to your use of the Service (defined below) offered by Ponture AB (559025-3471), its affiliates and suppliers (also referred to as “we”, “us”, or “our”), and in particular, but not limited to, our processing of Personal Data (defined below) in connection with such Service.

The term “Personal Data” means information relating to an identified or identifiable individual (i.e. a natural person).

The term “Service” means any information, data and features made available on this website www.ponture.com and otherwise in connections with its use.

We are committed to protecting your privacy and are responsible for processing of Personal Data according to the Swedish Personal Data Act (SFS 1998:204).

By using this Service and/or by submitting Personal Data to us, you agree to the terms of this EULA and express your consent to the processing of your Personal Data in the manner set out in this EULA. If you do not consent to the terms and conditions of this EULA, please do not use the Service.

Disclaimer of liability for Services

You acknowledge and agree that the Service is provided on an “as is” basis, unless otherwise expressly agreed. Your use of or reliance upon the Service and any third party content and Services accessed hereby is at your sole risk and discretion.

We disclaim any and all representations, warranties and guarantees regarding the Service, and the accessibility, accuracy, validity or completeness of the Service and any information or features available through the Service, and in particular any and all liability for information, acts, omissions and conduct of any third parties.

We will, under no circumstances, be liable to you or anyone else for any loss, injury or direct, indirect or consequential damages arising out of or in connection with your access or use of, or inability to access or use, the Service.

Credit report and know-your-customer review

We may request a credit report on you from a credit report institute such as Swedish Upplysningscentralen (UC).

As a condition for processing any application from you, we will also ask you to provide all information we may in our discretion find necessary to comply with applicable rules on anti-money laundering and financing of terrorism.

Your responsibility for information and data

You warrant that all information and data you provide to us is complete, true and accurate, and recognize that it will be relied on both by us and any parties we cooperate with, e.g. lenders. You agree to keep us fully indemnified against any cost, liability or damage, we may suffer due to any misrepresentation or otherwise due to information or data provided not being complete, true and accurate.

Personal Data collected

We collect information and data including name, address, e-mail address, phone number, birth date, personal identification number (Sw personnummer), account number, password and other credentials to secure your identity, and authenticate and validate your actions or that may be needed to provide you with the products and services you have requested or to communicate with you. It will also include any other information you submit to us using the Service. We also collect information in server logs etc when you use the Service. 

We will store your Personal Data and other information that you provide to us through the Service as long as you have any customer relationship with us, and thereafter to the extent they are relevant to any queries and disputes that may arise. Thereafter, we will delete all of your Personal Data from our records, apart from any data that we are required to keep for legal purposes. We will however keep unidentifiable data for statistical purposes.

In addition to what is stated above, we will collect data in a form that cannot, on its own, be referred to a specific person. We may collect, use, transfer and disclose non-personal information for any purpose. For example, we may collect and store details of how our Service is used, including search queries. This information may be used to improve the relevancy of results provided by our Services. If we combine non-personal information with personal information the combined information will be treated as Personal Data for as long as it remains combined.

The purpose for which the Personal Data is processed

Your Personal Data may be processed for the following purposes:

  1. to perform our obligations towards you;
  2. to ensure the security of the Service;
  3. to create, develop, improve operate and deliver our products and services;
  4. to communicate with you, for example, to provide information relating to our Service or to contact you for customer satisfaction queries;

Sharing your Personal Data

We will not sell, lease, rent or otherwise disclose your Personal Data to unauthorized  third parties without your explicit consent unless expressly otherwise stated below.

We may provide your Personal Data to third parties who work on our behalf for the above mentioned purposes. Such parties are not permitted to use your Personal Data for other purposes, and we require them to act consistently with applicable law and this EULA and to use appropriate security measures to protect your Personal Data.

We may share non-personally identifiable information with our affiliates, for example, we may share information to show trends about the general use of our Service and other statistics.

We may be obligated by mandatory legislation to disclose your Personal Data to certain authorities, such as law enforcement agencies. We may also process your Personal Data if needed to defend our legitimate interests in civil or criminal legal proceedings.

In the event that we are acquired by or merged with a third-party entity, or we transfer the Service to a third party, we reserve the right, in any of these circumstances, to transfer or assign your Personal Data and other information that we have collected from you as part of such merger, acquisition, sale, transfer or other change of control.

Security of your Personal Data

We recognize our responsibility to protect the Personal Data and other information you have provide us. We take appropriate technical and organizational security measures to safeguard your Personal Data against loss and misuse, as well as unauthorized access. 

All access to Personal Data is strictly monitored (audit logs) and direct access to the database is restricted to selected administrators. We perform regular security reviews and security patches are applied on the servers and firewalls. However, we cannot fully eliminate all security risks associated with Personal Data and we cannot be held liable for any unauthorized access or use of the data you have supplied to us.

Your right to correction etc

You have the right to once a year request a transcript of the Personal Data that we have about you. You may request to have inaccurate or incomplete data corrected or deleted. We may not be able to continue to provide the Service to you, if you wish us to delete or cease the processing of your Personal Data.

Please note that Company may need to identify you and to ask for additional information in order to be able to fulfil your above request. Please also note that applicable law may contain restrictions and other provisions that relate to your above rights.

You are not allowed to, in an automated and/or commercial way, disseminate or publish the information received through the Service. 

Cookies

We use cookies to improve the experience of using the web-site. Certain cookies are essential for the proper function of the site and we use analytics cookies to help us understand what content is most useful to our visitors, but we don’t track your personal activities when you’re not on our site.

The cookies we use includes cookies among other things to (i) secure access to your account, (ii) store chosen preferences, (iii) enable us to analyze user patterns, and (iv) show you relevant information based on previous searches.

Changes to the EULA

We may from time to time change this EULA or otherwise change, modify or withdraw access to the Service at any time, with or without notice. We will post such change on our website.

We recommend that you occasionally revisit this EULA to learn of any changes. Your continued use of the Service constitutes your agreement to this EULA and any future revisions.

Governing law and disputes

This EULA shall be governed by and construed in accordance with Swedish law.

Any dispute, controversy or claim arising out of or in connection with this EULA, or breach, termination or invalidity thereof, shall be settled by Swedish courts with Stockholm District Court as court of first instance.
